Liability and legal expenses cover: what is the difference?

Facing a claim for damages or a dispute? Distinguish home insurance liability cover from legal expenses cover and find the terms you need to check.

Go to the steps

THE SHORT ANSWER

Liability cover and legal expenses cover are both part of home insurance, but answer different questions. Liability cover concerns a claim for damages against you. Legal expenses cover can pay for legal representation in certain disputes. The names do not mean every demand or dispute is covered.

Start by describing the situation in one sentence. Is someone asking for money for damage you allegedly caused? Or has a demand between you and someone else been rejected? That distinction helps you find the right section and ask the insurer a clear question. [1][3]

Keep these points in mind

  • A claim for damages is not established liability.
  • Legal expenses cover applies to certain disputes, with conditions and your own costs.
  • Keep both current terms and earlier insurance periods.

STEP BY STEP

How to check your cover

  1. If someone demands damages: report the demand

Keep the demand, dates, photographs and account of the event. Send these to your home insurer and ask about liability cover. Request a case number.

Liability cover can investigate whether you are liable for damages when the demand falls within the agreement. Do not accept liability or promise payment before the assessment. Give a factual account of what happened and what remains unknown.

    [2]
  2. For a dispute: collect the demand and response

Put the demand and the other party's response next to each other. Note what you disagree about, the amount and when a demand was rejected. If describes a dispute as a demand being rejected in whole or in part. General concern about a future problem is not the same evidence.

Look for the Legal expenses section of your agreement. Ask the insurer how to apply, which representative can be used and what documents are needed. Ask about costs and scope; speaking to a lawyer does not by itself mean the insurance pays.

    [3][4]
  3. Check the periods before your latest change too

Konsumenternas describes a common requirement of two years' continuous home insurance, including with different insurers, but also exceptions. The date on your latest policy schedule is therefore not always the only deciding factor.

Collect earlier schedules or insurance certificates and mark any breaks. Add when the event underlying the dispute occurred and when the dispute arose.

  4. Read the limits before calculating costs

Check the maximum payment, excess, hourly rate covered and excluded costs. A high limit is not a promise that every invoice is covered.

Folksam specifies, for example, that its legal expenses cover does not pay representative's costs incurred before the dispute arose. This is an insurer example to check against your own agreement, not a decision about who pays in your case.

WHEN SOMEONE CLAIMS DAMAGES
Liability cover only pays if you are liable. Amounts, excess and exclusions are set out in the terms.

Not every legal issue goes through home insurance

Which disputes are covered depends on the agreement's terms. Folksam excludes employment-related disputes from its home insurance legal expenses cover, for example. A car-related issue may instead need assessing under motor insurance. Ask the insurer to identify the right policy and section.

Check any requirements concerning the amount in dispute, which court can hear the case and special rules for family-related disputes too. Read the exclusions alongside the main rule. Do not use the heading Legal expenses as advance confirmation of payment.

[4][1]

Separate legal costs from the demand itself

When writing down your questions, make two columns: what the dispute concerns and the cost of pursuing it. Legal expenses cover concerns certain legal costs, not a promise that insurance will pay the amount the other party demands. Ask what any decision actually covers.

A claim for damages that liability cover can handle should not automatically be treated as a legal expenses claim. Ask the insurer which cover it is assessing the case under and keep its response with your documents.

See what the documents say before calling

In My Forsio, you can bring together policy schedules and terms and open available source documents. Look for liability and legal expenses cover separately. If the scope or a limit is not shown, it needs verifying with the insurer.

Claim check Beta can help you read relevant terms within its supported areas. Forsio is not your legal representative and does not assess your legal liability. The insurer assesses insurance payments; a dispute may require your own legal help.

Fictional example

Two headings, different questions

Mika reads the home policy after receiving a demand from a neighbour.

Neighbour's claim for damages
Report to liability cover
Mika's liability
UnverifiedThe demand needs investigating.
Legal expenses limit
UnverifiedThe documents do not show an amount.

No payment or debt is confirmed. A policy name cannot replace assessment of the demand and terms.

Common questions

Must I stay with the same insurer for two years?

The usual continuity requirement can include time with different insurers. Keep evidence of the periods and check breaks and exceptions with the insurer assessing the application. [1]

Does legal expenses cover pay for every contact with a lawyer?

No. Check which disputes and costs are covered and how to apply. Ask about the representative, timing and excess before counting on payment. [4]

Can Forsio represent me in the dispute?

No. Forsio helps you find and understand your insurance documents. The insurer assesses cover, and a legal representative acts for you if you engage one.
